In 2015 the House of Delegates of the American Bar Association (ABA)
adopted a proposal to provide an additional delegate to those delegations
that did not have a young lawyer delegate prior to the 2015 ABA Annual
Meeting. North Dakota was one such delegation. As a result, the Board
of Governors of SBAND voted to add the Young Lawyer Delegate, and
intends to modify SBAND’s by-laws to do so.
Pursuant to the By-Laws of the State Bar Association of North Dakota,
specifically Section 14.1, the Board of Governors of SBAND intends to
amend the By-Laws as follows: (Changes and new language underlined.)
11. MEMBERS OF HOUSE OF DELEGATES
OF AMERICAN BAR ASSOCIATION
There shall be elected in each even-numbered year one delegate to
represent the Association in the House of Delegates of the American Bar
Association who will hold office for a period of two years ending at the
adjournment of the annual meeting of the American Bar Association in
even-numbered years, or until a successor has been elected by the State
Bar Association. Duties of the ABA Delegate are those prescribed by the
American Bar Association and the State Bar Association. The Delegate
shall attend all meetings of the House of Delegates of the American Bar
Association called during the term of office or until a successor is elected.
There shall also be elected in even-numbered years a Young Lawyer to
represent the Association in the House of Delegates of the American
Bar Association. The delegate must be admitted to his or her first bar
within the past five years, or be less than 36 years old at the beginning of
his or her term. The delegate must be an ABA member in good standing
throughout his or her tenure as delegate. (The delegate will be elected
at an Annual Meeting of the Association from a slate of one or more
eligible candidates selected by the Associations’ Young Lawyers Section).
The term of the first delegate begins immediately after election, and
expires at the conclusion of the 2018 Annual Meeting of the Association.
The delegate will hold office for a period of two years, and may be reelected until such time as they do not qualify for the position.
