Where the Rubber Hits the Road
This article in the VBJ series on legal writing tips, introduces the debut appearance
of Theo, a retired Vermont judge and a descendant of Theophilus Herrinton (Judge,
Vermont Supreme Court 1803-1813). Theo
will appear from time to time in these
pages to offer words of wisdom to young
lawyers.
I saw my nephew’s son, Chance Herrinton, at Capitol Grounds on Friday afternoon. He was sitting at a table in the corner by himself. He had a thick legal file in
front of him and a puzzled expression on
his face. Chance is a new associate at Bennington and Bates. He graduated from law
school only a year ago. He’s an affable kid
and a hard worker from what I hear. I know
him to be a rational, no nonsense, nose-tothe-grindstone sort of fellow. I got a double
shot of espresso and sat down at his table.
“How are things going, Chance?” I
asked. He looked up a little glassy eyed
and said, “Theo, I’m puzzled.” “I can tell
