Shipping & Delivery
Shipments are subject to availability. Orders for immediate shipment are based on availability, and
cannot be back-ordered or otherwise extended without the written permission of Plastpro. All orders
must be shipped direct to the Distributor’s yard in standard packaging. If shipments are not shipped
in even units the Distributor will be subjected to a service charge. Plastpro will devote its best efforts

to meet the requested delivery schedule but does not guarantee a delivery date or time, and assumes
no liability for any loss or damage suffered by the Distributor, the Distributor’s customer or end-user
due to late shipments, incomplete quantities, or Plastpro’s inability to furnish the desired products and
quantities. Risk of loss or damage shall rest on Distributor after shipment from Plastpro. Upon receipt of
the order, Distributor must check and will be responsible for noting the accountability and acceptability
of goods. Any damage, loss, shortage, or misidentification should be reported to the driver and noted
on the Bill of Lading immediately upon delivery, a copy of which must be received by Plastpro within
7 days of delivery. In these cases, it is the responsibility of the receiver to note any divergence from
the order. Plastpro reserves the right to ship orders at the most economic rate. When the Distributor
requests special packaging or handling, the additional cost will be billed to the Distributor.
Cancellation
Distributor may cancel an order on standard products prior to Plastpro contracting a freight carrier for
shipment, in which case Distributor shall be subject to liquidated damages of the cost of labor, storage
overhead, and material used, plus 25% of the sales price. In the event of Distributor canceling after
shipment has begun, Distributor will pay any freight charges incurred in addition to charges for labor
storage overhead and material costs plus 25% of the sale price. Non-standard or custom-produced
products are not subject to Distributor’s cancellation once production has begun. In the event of
cancellation or Distributor’s failure to release for shipment, Distributor will be billed for the entire
amount of the order including the cost of canceled or unshipped products. The Distributor cannot
refuse or return part of a nonstandard or custom produced order.
