JDPA - JUVENILE JUSTICE AND
DELINQUENCY PREVENTION ACT
There is consensus across the political
spectrum that our criminal justice system
is out of balance and in need of reform.
Reauthorization of the JJDPA enacts
bipartisan “smart-on-crime” reforms that
achieve cost savings and reduce crime. The
ABA asked for reauthorizing legislation that
requires states to end jailing of youth for
non-criminal offenses, implement databased steps to reduce racial disparities in the
juvenile justice system, and strengthen access
to counsel.
This year’s meeting will include a tentative
draft of the Restatement of the Law, The
Law of American Indians. The proposed
restatement aims to cement the foundational
principles of American Indian law, including
federal/tribal relations, tribal jurisdiction and
authority, and Indian Country business law.
The Institute will also discuss a draft of
the Restatement of the Law, Liability
Insurance. The liability insurance project
seeks to develop principles of contract law in
the liability insurance context, principles of
liability insurance coverage, and principles of
the management of insured liabilities.
Finally, the Restatement of the Law Third,
Torts: Intentional Torts to Persons will be
considered for approval in a tentative draft
form. This is the latest installment of the
ALI’s ongoing revision of the Restatement
Second of Torts. This project will complete
the major avenues of recovery
