Prohibited Activities:
It is unlawful for any person, who intentionally participates in the operation and management of an enterprise, directly or indirectly, to:
-knowingly do so, directly or indirectly, through a pattern of predictive activity
-knowingly cause another to violate this article
-knowingly conspire to violate this article
PENALTY: 7-30 years of imprisonment or the penalty range for the underlying predicate act-whichever is higher.
Predicate Activity: Includes solicitation of murder for hire; first degree murder; drug induced homicide; kidnapping; aggravated kidnapping; aggravated
unlawful restraint; forcible detention; child abduction; trafficking in persons; criminal sexual assault; aggravated criminal sexual assualt; predatory crimial
sexual assault; aggravated criminal sexual abuse; indecent solicitation of a child, indecent solicitation of an adult; promoting prostitution; promoting
juvenile prostitution, patronizing a minor engaged in prostitution, aggravated discharge of a firearm; residential burglary; armed robbery, aggravated robbery;
unlawful possession of a firearm by a street gang member; aggravated possession of a stolen firearm; cannabis trafficking; manufacture or delivery of
cannabis; manufacture or delivery of a controlled substance; controlled substances trafficking; calculated criminal drug conspiracy; street gang criminal drug
conspiracy; manufacturing or delivery of methamphetamine [720 ILCS 5/33G3].
Unlawful Possession of a Firearm by a Street Gang Member: A person commits unlawful possession of a firearm by a street gang member when he/she
knowingly possesses, carries or conceals on or about his/her person a firearm and firearm ammunition while (not on their own property) has not been issued
a currently valid FOID card and is a member of a street gang [720 ILCS 5/24-1.8]. (Penalty - Class 2 Felony - 3 to 10 years imprisonment)
