he acknowledged that they would have four guest suites in the home , each having a private bedroom , bathroom and closet that is behind a lockable door . He said these four suites equal about 25 % of the home . Linda told the Planning Board that the kitchen should not be included in the 50 % calculation since she , and not her guests would be doing the cooking .
In a July 24 , 2017 letter , Code Enforcement Officer Tom Corcoran determined that if the Cools were to occupy the home full-time “ the overnight accommodations would then be secondary to the use as an owner-occupied one family home .” This would meet the code . Corcoran also reviewed calculations made of the interior usage by the guests and the owners . Though he disagreed with a portion of these figures , he noted that since the kitchen , dining area , living room , family suite and the third floor multi-media lounge would not be used by the guests , he concluded that the Cools “ met the 50 % use limitation of the structure .”
The Cools said the recent final approval of their project by the Planning Board took only a few minutes , leaving them pleased but wondering how it all concluded in their favor .
When asked if they will move over to the 5 West St . address , the Cools said they already spend a lot of time there and have a room they use in the house .
“ Will we sleep there 365 days a year ?, no , but we do not sleep 365 days in our current house ,” Ken said . “ We own property in other parts of the country , an inherited family house . We are retirees and we travel so we don ’ t spend 365 days anywhere .”
During the process the Cools said they found the Marlborough town code “ riddled with ambiguities and contradictions .” They believe municipalities with code issues should not make “ inappropriate interpretations of rules that don ’ t exist ... and towns should pull back from over interpreting rules and regulations that may interfere with an owners enjoyment of his or her private property .”
The Cools also believe applicants who pay into escrow accounts are actually paying twice , once for their own attorney and consultants and again to pay for the town ’ s attorney and engineer , with no check on the number of hours racked up by the town ’ s team .
Linda said she is “ delighted ” with the Planning Board ’ s decision and is looking forward to running their Bed & Breakfast . They are willing to assist the town in updating the code to “ find a way to help the next applicant not stumble so much .”
Ken added a few final thoughts on the process they experienced .
“ The problem is that people must understand the distinction between their professional obligations and their personal views ,” he said . “ What I put them all to account is to do their job professionally to the best of their abilities within the delineated , written processes and procedures of the town . When they do not do that they will always have a problem with me . They take that as a personal insult , no , it ’ s their responsibility as either

Stankus , 30 , of Brooklyn , NY was arrested Sept . 4 and charged with Driving While Intoxicated and Unlawful Possession of Marijuana after the vehicle he was operating was stopped for traffic violations on Rte . 9W in Highland . He was released on an appearance ticket and due back in Town Court Sept . 28 .
Desiree L . Smetana , 24 , of Wappingers Falls , was arrested Sept . 2 on a bench warrant for Aggravated Unlicensed Operation 3rd degree from the City of Poughkeepsie Police . Smetana was turned over to the City of Poughkeepsie Police on the warrant .
Scott E . Parker , 49 , of Highland , was arrested Sept . 2 and charged with Disorderly Conduct after he was involved in a dispute with another person . He was released on an appearance ticket and is due in Town Court Sept . 14 .
Andrew O . Eggers , 27 , of High Falls , was arrested Aug . 28 and charged with Aggravated Unlicensed Operation 2nd degree and Operation of a Motor Vehicle with a Suspended Registration after the vehicle he was operating was stopped for traffic violations on Rte . 9W in Highland . He was released on tickets and is due in Town Court Sept . 21 .
Benjamin B . Zarzycki , 36 , of Marlboro , was arrested Sept . 1 and charged with Aggravated Unlicensed Operation 3rd degree and Unlawful Possession of Marijuana after the vehicle he was operating was stopped for traffic violations on Rte . 9W in Highland . He was released on tickets and is due in Town Court Oct . 5 .

Rivera , 34 , homeless ; was arrested Sept . 11 on a bench warrant for Driving While Intoxicated , Resisting Arrest , Harassment 2nd degree and Obstructing Government Administration 2nd degree . Gerald Ingle , 30 , of Milton , was arrested Sept . 3 and charged with Unlawful Growing of Cannabis and Unlawful Possession of Marijuana . Ingle was released on his own recognizance and is due in Town Court Sept . 19 .
Leisly A . Feliciano , 34 , of Poughkeepsie , was arrested Sept . 4 as a Fugitive on Warrant for Extradition . Feliciano was arraigned on Sept . 4 with Cash Bail set $ 250.00 and Paid . She was due in Town Court Sept . 5 .

A 57 year-old from Milton was arrested Sept . 7 and under the Mental Hygiene Law was transported and released to a 3rd Party - the Mid Hudson Regional Hospital .

State Police at Highland announce the arrest of Jason Awal , age 43 of Port St . Lucie , FL for Sexual Abuse in the First Degree .
On September 5 , 2017 , Awal was taken into custody from the result of a warrant investigation . Awal was charged in the Town of Saugerties and the Town of Plattekill with Sexual Abuse in the First Degree ( a Class D Felony ). The incidents occurred over 10 years ago when the victims were less than thirteen years old at the time of the alleged crime .
Awal was arraigned in the Town of Saugerties Court and remanded to Ulster County Jail in lieu of $ 100,000 Cash or $ 200,000 Bond .
The State Police were assisted by the Town of Newburgh Police Department .
