How do Road Bans Work? As conditions continue to warm up and the snow melts, the activities of hauling commodities to market or seed cleaning plants, plus hauling in fertilizer or other farm supplies (including livestock feed), continue to progress. These seasonal activities converge with MD road bans coming into effect. Road Bans are a legislative tool used by the province and/or the MD to mitigate road damage during certain times of the year (usually spring). Bans are placed on a combination of roads or selected roads where damage of heavy loads may occur for a certain period. This lessens damage to the roads and avoids excessive costs of repair or potential liability claims, while providing safety to the motoring public and protecting individuals hauling on these roads. Within the MD, spring Road Bans are usually placed on all gravel roads at 75% through thaw conditions, meaning that all trucks or truck trailer combinations are only allowed to haul 75% of their licensed allowable axle weights. Road Bans are placed on other surfaced type roads, e.g.: paved or oiled, on a site-specific or case by case basis. For the ag community there are some exceptions: • Vehicles or a combination of trailer vehicles that do not exceed 5,000 kg. • Rubber tired farm tractors without the trailer. • Trucks and or tractor/trailer combinations that are only crossing municipal roads. • 90% axle weight maximum on a Road Ban imposed road for trucks and/or combination of tractor/trailer combinations hauling only the following: domestic drinking water, heating fuel, fertilizer or livestock feed. All other commodities including livestock and other farm supplies need to adhere to all road bans and pertinent weight restrictions. However, if you still wish to haul above the weight restricted axle weight limit, you may be able obtain a valid special permit. These permits may be issued with special conditions, such as hauling when road conditions are favourable, i.e. frost conditions, between certain hours of the day, and/or possible route restrictions. To obtain a special permit, call the main MD Office at 780.849.4888 a minimum of 24 hours prior to the intent of haul time (there is a $25 fee). It is the responsibility of the hauler/ vehicle operator to ensure that all road bans are adhered to. If you are stopped by a Peace Officer or Highway Patrol and found overweight on a banned road, penalties range between $27 to $34/per 100kg overweight, plus a victim surcharge of 15%.
