It is important to note that the cost elements listed above are those costs related to the Construction Management activities only . The Total Construction Costs contained in the GMP would be developed after the CMAR has been selected and has competitively bid all the sub-trade work .
There appeared to be ambiguity in the Florida Administrative Code regarding a government agencies ability to select a CMAR using a Best-Value procurement method . The Town Attorney sought a clarification from the Florida Attorney General on the subject . It was the Florida Attorney General ’ s conclusion that a CMAR may only be procured by a governmental agency under a Qualifications-Based methodology as provided for in the Florida Administrative Code . This is consistent with how the Town has procured CMARs in the past and based on this conclusion , this master plan recommends procurement of CMARs for this program consistent with the Florida Attorney General ’ s conclusion .
Another resource the Town has available to assist in GMP / Contract Negotiations with the selected CMAR is the use of an expert in the field of construction to aid in the negotiation . The Town has already established a relationship with such an expert ( Peter Brandt ) and could request his involvement during this process to further ensure that the terms and fee offered by the CMAR are fair and equitable to the Town .
