Drainage and Water
Water, and the ability to remove it, is extremely important to
Ohio farmers. Each growing season, Ohio’s farmers encounter
issues with the amount of water on their property: either too
much due to excessive rain and ineffective drainage or too little
due to drought or interference with moving water. Being a
water-rich state, Ohio historically limits statutory law related to
water rights, and much of our water law comes from cases that
have presented themselves to the courts. Therefore, the legal
implications of drainage issues are tremendously fact specific.
