Martensville Man ’ s Manslaughter Charges Stayed

Shanine Sealey , Martensville Messenger
The parking lot of the Adobe Inn in Martensville was a hub of activity on Sunday , April 4 , 2015 . On this night , at approximately 1:30am , police were called to the scene where they found a 44 year old man unconscious with severe head injuries . The male , Vance Labrecque , was immediately transported to Royal University Hospital to be treated . On April 25 , 2015 at approximately 10:40am , Labrecque succumbed to his injuries and passed away .
RCMP executed numerous interviews with witnesses , reviewed surveillance videos and analyzed evidence to determine what had taken place that night . Charges in this incident were laid against Martensville resident Morgan Kendall Upton , who was 20-years-old at the time , and on April 8 , 2015 Upton surrendered himself to local authorities . The charges were initially for Assault ; however , after Labrecque ’ s death , the charges were upgraded to Manslaughter .
Witnesses stated that a brief altercation occurred between the two men outside of the bar . The victim was pushed to the ground which is when the head injury took place . The matter was then referred to the Crown for “ consideration of amending the charge due to the change in circumstances .”
On December 8th , the charge against Upton was stayed , and the defendant will no longer be standing trial . Upton ’ s lawyer commented that his client happened to be in the “ wrong place at the wrong time ” and that he was acting in selfdefense . According to witnesses , Labrecque was allegedly attempting to pick a fight with Upton ’ s father outside of the establishment , and according to said witnesses , Labrecque then sucker-punched Upton in the face . From there Upton grabbed the deceased , who then fell and hit his head on the ground , causing the injuries that ultimately caused his passing . Following his death , members of Labrecque ’ s family described the man as a ‘ big kid ’, who loved animals and never wanted to hurt anyone . In an event where a charge is stayed , the Crown will not provide any specific details as to why the charge has been stayed ; however , they have up to a year to reinstate the charges in the case that more evidence is presented .
