T
he Depar tment of
Occupational Safety and
Health (DOSH) is one
of the enforcement agencies
under the Ministry of Human
Resources Malaysia. Briefly, the
role of the DOSH is to secure
the safety, health and welfare
of persons at work and others in
the place of work, against risks
to safety or health arising out of
the activities of those who are
working.
In order to realise its
mission to ensure safety and
health at work, DOSH conducts
three main activities – setting
standards, enforcement and
promotion. Enforcement
activities are based on three
main Acts, namely the Factories
and Machiner y Act 1967,
Occupational Safety & Health
Act 1994 and Petroleum
(Safety Measure) Act 1984.

One of the regulations under
the Factories and Machinery
Act 1967 enforced by DOSH is
the Factories and Machinery
(Electric Passenger and Goods
Lift) Regulations, 1970 which
governs the installation and
operation of lifts.
Section 19 of the Factories
and Machiner y Act 1967,
established the need for
those machineries to have
a valid Certificate of Fitness
(COF) before the machineries,
including lifts and escalators
can be operated. Factories

Regulations, 1970 is the
specific regulation under the
Factories And Machinery Act,
1967 which covers the control
of machineries with regard to
matters relating to the to the
installation, registration and
inspection of machinery and for
matters connected therewith.
It also provides the control on
matters relating to the safety,
health and welfare of persons at
factories and workplaces.
In the process of obtaining
permission to install a lift and/
or escalator, DOSH reviews the
design of the machine prior to
installation before operation
is allowed. The Factories and
Machinery (Electric Passenger
and Goods Lift) Regulations,
1970 serves as a key reference
in the review of an application
to install machineries. If there
is any non-compliance with
the prescribed rules, the
applicant must apply for an
exemption from complying
with the regulations. The
only exceptions that will be
considered, are if they comply
with the requirements specified
