requirements under the Act or any other law relating to the supply of professional engineering services by the body corporate .
The registration of Single Disciplinary Practice ( SDP ) can be summarised as shown in Figure 2 .
Multi-Disciplinary Practice ( MDP ) Where a body corporate carries on a practice of providing a combination of services comprising professional engineering services , architectural consultancy services or quantity surveying services , the Board may , subject to such conditions and restrictions as it may deem fit to impose , register that part of the service providing professional engineering services .
Such body corporates must be incorporated under the Companies Act 1965 and fulfil the following conditions : - a . It has a board of directors who shall be subject to such conditions and qualifications as may be prescribed by the Board b . The shareholdings shall be as may be prescribed by the Board c . Has a minimum paid-up capital which shall be an amount as may be prescribed by the Board ; and d . the day-to-day affairs of the body corporate shall be under the control and management of a person who A . is a Professional Engineer with
Practising Certificate and
B . is authorised , under a resolution of the board of directors of the body corporate , to make all final engineering decisions on behalf of the body corporate in respect of the requirements under the Act or any other law relating to the supply of professional engineering services by the body corporate . The Regulations have been amended to reflect the amendments to the REA .
Paid up capital & equity and Composition of the Board of Directors have been inserted as follows ; i . a minimum paid up capital of RM50,000.00 ; ii . at least 70 % of its share equity held by Professional Engineers each with Practising Certificate ; and iii . the remaining share equity may be held by any persons , bodies corporate or persons and bodies corporate .
2 A body corporate registered under Multi- Disciplinary Practice ( MDP ) shall have : i . a minimum paid up capital of
RM150,000.00 ; ii . at least 70 % of its share equity held by Professional Engineers each with Practicing Certificate , Professional Architects and / or Consultant Quantity Surveyors ; of which the Professional Engineers each with Practising Certificate providing professional engineering services shall hold a minimum share of 10 %; and iii . the remaining share equity may be held by any persons , bodies corporate or persons and bodies corporate .
Composition of Board of Directors
1 A body corporate registered as an Engineering consultancy practice under Single Disciplinary Practice ( SDP ) shall have : i . a Board of Directors where at least 2 / 3 of its members are Professional Engineers each with Practicing Certificate ; ii . the remaining members of the Board of Directors may be anybody or persons ; and iii . the person named under sub-section ( iv ) of section 7A of the Act shall be a Board Director of the body corporate
2 A body corporate registered under Multi- Disciplinary Practice ( MDP ) shall have : i . a Board of Directors where at least 2 / 3 of its members are Professional Engineers each with Practicing Certificate , Professional Architects and / or Consultant Quantity Surveyors ; ii . the remaining members of the Board of Directors may be anybody or persons ; and iii . the person named under sub-section ( d ) of section 7B of the Act shall be a Board Director of the body corporate .
