Case Study:
Joe works as ground staff every Saturday without fail for roughly six hours and has done so
for the past 20 years, the club is his life.
In gratitude for his devotion to the Club they give him £30 every Saturday after the match.
This all seems perfectly fine, Joe is happy, the Club is happy with Joe……. until Joe becomes
seriously ill and cannot attend the matches any longer and the Club is stuck without a
Grounds Man!
Joe asks for sick pay as he is out of pocket on a Saturday, the Club however say as he’s only
voluntary so he wouldn’t receive Statutory Sick Pay (SSP) and dismisses both his claim and
him.
Joe looks into his case ….
Joe has received a wage therefore – is an employee!
Joe entitled to - All Employee Rights!!
Sick Pay - National Minimum Living
Wage - Holidays - Payment of Notice
and
can pursue a claim for
Unfair Dismissal
