15.0 16.0 17.0 SALE AND CONSUMPTION OF FOOD AND BEVERAGES 15.1 The Culture and Leisure Trust’s designated contractor shall have the exclusive right to sell food and beverages within the Theatre. 15.2 The Hirer may not provide food or beverages free of charge to members of the public without the consent of the contractor and the Culture and Leisure Trust. In circumstances where permission has been given, the Hirer must ensure that his/her activities conform to all Food Safety and Environmental Health legislation and guidelines. This may also entail inspection and approval by Culture and Leisure Trust Environmental Health Officers. 15.3 In the event that the Hirer has specialist catering requirements which cannot be met by the Culture and Leisure Trust’s designated contractor and the contractor waives his/her exclusive right to sell food and beverages, the Hirer may, at the discretion of the Culture and Leisure Trust, make provision for his/her own catering. In such circumstances, the Culture and Leisure Trust’s designated contractor shall be under no obligation to make any of his/her equipment or the facilities designated for his/her sole use, available to the Hirer, nor shall the Hirer be permitted to use the café furniture in the ground floor foyer. Any such catering provision by the Hirer may be subject to inspection and approval by Culture and Leisure Trust Environmental Health Officers. 15.4 Whilst it is accepted that it is customary to consume sweets, etc. in a theatre auditorium, the Culture and Leisure Trust reserves the right to forbid the bringing into the auditorium of items which in the opinion of the Authorised Officer may cause damage or staining to the fabric, furniture and fittings of the Theatre. SALE OF MERCHANDISE 16.1 The Hirer may undertake the sale of merchandise – for example souvenirs, T-shirts, CDs, photographs, etc. – during a Let with the prior written agreement of the Authorised Officer. The Hirer is required to provide a detailed list of all items which he/she proposes to sell at the Production Meeting. 16.2 All items offered for sale must comply with the terms and conditions of the Sale of Goods Act 1994 and any other relevant legislation. Where necessary, the Hirer will be responsible for securing any additional permissions or inspections from relevant bodies. 16.3 The Culture and Leisure Trust accepts no liability whatsoever for any items sold to third parties. 16.4 The sale of merchandise must not interfere with the effective running of the Theatre or the ability of other visitors to the Theatre to use the areas deemed to be open to the general public. 16.5 The Hirer will pay to the Culture and Leisure Trust commissions on any agreed merchandise sales at the rate stipulated in the Schedule of Fees and Charges current at the time of the Let. CONTROL OF ADMISSION TO THE THEATRE 17.1 In accordance with the Management Rules for Eastwood Park Theatre, the Authorised Officer may, if he/she deems it necessary, refuse admission to the Theatre, or any part thereof, or eject any person who has already gained entry. 17.2 Use of the Theatre, or any part thereof is granted only to those participating in the activity for which the Let has been granted and who is either a registered member of, a guest of or a person employed by, the Hirer. 17.3 It is the responsibility of the Hirer’s designated Company Manager to maintain records of the number of cast and crew who are in the Theatre at any given time. It is recommended that a Company Register for all visiting personnel is used for signing in and out of the building to achieve this. This information must be given on request to the Authorised Officer. 17.4 Designated Stewards – either Culture and Leisure Trust staff or individuals acting on behalf of the Hirer – will be responsible for controlling admission to specific areas of the Theatre, and in particular for ensuring that maximum occupancy levels for these areas are not exceeded 14
