Among many other pressing issues facing our nation, Senator Harry Reid has indicated that online gambling will be a priority as we begin the 113th legislative session. We continue to believe that federal legislation – allowing for state-based online poker only – is necessary for a number of reasons. Such legislation would establish federal minimum standards that address consumer protection, prevent underage gambling, promote responsible gaming and help those with gambling problems. Without such standards, we would see a patchwork of regulations across the borderless internet as states legalise various forms of online gambling one by one. The state-by-state approach fails to provide a regulatory mechanism allowing Native American tribes to participate in the online poker arena. It is needed to provide law enforcement entities with the tools to prosecute illegal operators and keep them out of the US market. States would not have the ability to accomplish this nationally. With more and more states considering online gambling legislation in the coming year, Congress must move quickly on a federal solution.
