CITY AND STATE DIVERSE SUPPLIER PROGRAMS
The 1989 Croson vs. City of Richmond court decision declared race-based set-aside programs unconstitutional
- unless discrimination was documented. This decision resulted in the dismantling of many state and local
diverse business utilization programs and, later, launched a series of disparity studies in an effort to prove
past discrimination.
Because many jurisdictions are in various stages of determining the status of their set-aside programs,
preparing disparity studies, and undergoing additional court challenges, it is recommended that you contact
the individual jurisdiction with which you are concerned for current information.
