He engaged in conduct relevant to the practice of medicine that , having regard to all the circumstances , would reasonably be regarded by members as disgraceful dishonorable and unprofessional by ( i ) making remarks and gestures of a sexual nature as described above ; ( ii ) asking her to pay cash for prescriptions ; ( iii ) asking her to fill a prescription for Flamazine for him ; and ( iv ) asking her to video or photograph other patients .
Patient C Dr . Lee engaged in sexual abuse , in that he inappropriately rubbed his groin against Patient C ’ s right hip area while administering a trigger point injection . This was contact of a sexual nature . Dr . Lee also sexually abused Patient C by using sexually explicit and crude language when asking her personal questions about her sex life . These were remarks of a sexual nature . Further , Dr . Lee ’ s line of questioning with respect to Patient C ’ s personal sex life , and his choice of words when asking these questions would reasonably be regarded by members of the profession as disgraceful , dishonorable or unprofessional .
ORDER The Discipline Committee ordered : a reprimand ; the immediate revocation of Dr . Lee ’ s certificate of registration ; reimbursement to the College for funding provided to Patients A and C , by posting an irrevocable letter of credit for $ 32,120 to the College to guarantee payment of such amounts . He was also ordered to pay costs to the College in the amount of $ 20,500.00 .

APPEAL On December 1 , 2017 , Dr . Lee appealed the decisions on finding and penalty of the Discipline Committee to the Superior Court of Justice of Ontario ( Divisional Court ). The decision of the Discipline Committee remains in effect .

On June 15 , 2017 , the Discipline Committee found that Dr . Maranda committed an act of professional misconduct in that he has engaged in conduct or an act or omission relevant to the practice of medicine that , having regard to all the circumstances , would reasonably be regarded by members as disgraceful , dishonourable or unprofessional . Dr . Maranda is a cardiologist practising in Ottawa . He received his certificate of registration authorizing independent practice in Ontario in 2005 and his specialist qualification in cardiology in 2007 . In the relevant years , Dr . Maranda held privileges at the Ottawa Hospital . Also , in the relevant years , Dr . Maranda was an assistant professor and an “ ePortfolio ” group leader at the Faculty of Medicine at a University .
DISGRACEFUL , DISHONOURABLE OR UNPROFESSIONAL CONDUCT Ms . A was a student in Dr . Maranda ’ s ePortfolio group . Dr . Maranda ’ s role as group leader involved meeting with the group of students approximately twice a year to discuss issues associated with the process of completing medical school and preparing their e-portfolios . Each student in the group had to submit a draft final ePortfolio posting by the required deadline . The ePortfolio class was to be graded by Dr . Maranda on a pass-fail basis . A student would receive a “ pass ” so long as the student submitted the required postings . Ms . A requested an extension of time for submitting her draft posting . She explained to Dr . Maranda that she was experiencing personal difficulties following the end of a relationship . Dr . Maranda granted the extension . Later , Dr . Maranda offered to meet with Ms . A to offer supportive advice .
