DR. MOHAMMED HUSSEIN

On September 23, 2013, the Discipline Committee
found that Dr. Hussein committed an act of professional misconduct, in that he engaged in conduct or an act
or omission relevant to the practice of medicine that,
having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable or unprofessional. Dr. Hussein admitted to the
allegation.
Dr. Hussein provided incorrect, untrue and inaccurate
information in his application for a certificate of registration with the College in the following respects:
• e was not in continuous practice between 1995 and
H
2000;
• e was not practising medicine in Iraq between 1995
H
and 2000;
• e failed to disclose that he discontinued his medical
H
practice for over one year; and
• e declared that the answers he gave to the questions
H
in the applications were true, complete and without
the intent to mislead.
Dr. Hussein admitted that he also provided incorrect,
untrue and inaccurate information in his application for
a provisional licence with the Newfoundland Medical
Board, in the following respects:
(a) e was not in continuous practice between 1995
H
and 2000;
(b) e was not practising medicine in Iraq or Oman
H
between 1995 and 2000;
(c) e declared that the answers he gave to the quesH
tions in the applications were true, complete and
without the intent to mislead.
Reasons for Penalty
The Committee considered the aggravating and mitigating factors. The mitigating factors include the fact that
Dr. Hussein has had no previous discipline history with
the College. Dr. Hussein cooperated with the investigation and acknowledged his wrongdoing at the outset,

which demonstrated insight and remorse as well as
spared the College the cost of a contested hearing.
Aggravating factors include the fact that Dr. Hussein
made material misrepresentations to two Colleges, both
the College of Physicians and Surgeons of Ontario and
the Newfoundland Medical Board. In particular, Dr.
Hussein failed to disclose gaps in his medical practice
history, indicated that he had practised continuously
when he had not, and stated that he had practised at
other times and places when he had not. The College
relies on the accuracy of information provided by physicians and on the honesty of physicians in their dealings
with the College in order to self-regulate and to protect
the public.
The Committee considered that the proposed penalty
would uphold the relevant penalty principles of public
protection, specific and general deterrence, rehabilitation of the member and maintaining X
