Court Determination
3 If the court determines the dog is dangerous and has caused serious physical injury or death to a person, then the court must order
that dog to be humanely euthanized by a licensed veterinarian or authorized animal control official.
3 If the court determines the dog is dangerous but has NOT caused serious physical injury or death to a person, then the court must
determine whether the dog is likely to cause future serious physical injury or death. If the court determines by reasonable satisfaction
that the dog has such a propensity, the court may do one of the following:
Order that dog to be humanely euthanized by a licensed veterinarian or authorized animal control official.
OR
Order the dog to be returned to its owner, if all of the following conditions are met:
The dog is held in impound until the owner complies with all orders of the court. If the owner fails to comply within 30 days,
the dog will be humanely euthanized;
The dog is microchipped;
The owner pays an annual dangerous dog registration fee of $100 to the county, or a $100 penalty payment for
non-registration within two weeks;
The owner pays all expenses involved with the investigation, pickup, and impoundment of the dog, as well as any court
costs or fees related to the hearing;
The owner provides a certification of the dog’s current rabies vaccination;
The dog is spayed or neutered;
The owner obtains a surety bond of at least $100,000 that covers dog bites, injuries or death caused by the dog;
The owner provides proof to the court that a proper enclosure has been constructed to contain the dog.
