A S S O C I A T I F O E N A T N U EW S RE 29 Members of the Maryland Same Day Messenger Courier Association continue to participate in local govern- ment advisory boards and business organizations, ensuring that we are active corporate citizens and influen- tial in matters of importance to us. The MSDMCA has developed a good relationship with the current Governor of Maryland, Larry Hogan, as well as with his staff. Recently, the Secretary of Labor in Maryland proposed a number of changes in the Code of Maryland Regulations (COMAR) regarding the outdated burden of proof is that is the responsibility of employers in determining worker status. For instance, one of the factors that have been used to determine worker status as an IC is that the worker maintains a business listing in the telephone directory. The Secretary proposed chang- ing that language to “the extent to which the worker makes service available to the relevant market”. We in the MSDMCA support the Secretary in her efforts to update the COMAR to make it more relevant in today’s business climate. However, a couple State Senators proposed emergency legislation to prevent such changes (among other things). A Hearing was scheduled. Members of the MSDMCA were prepared to testify against the emergency legislation and in support of the Secretary. But the Bill was “pulled” the morning of the sched- uled hearing, presumably at the request of the sponsors. The primary mission of the MSDMCA is for member businesses to join together in fighting adverse legislation and regulatory changes in Maryland, and to promote the best interests of our industry in Annapolis and else- where. As such, we continue to monitor the advance of the proposed regulation changes and the actions of the legislators wishing to reverse the authority and actions of the Secretary. The Florida Messenger Association (FMA) continues to hold their monthly “Listen and Learn” which fea- tures speakers from a variety of industries impact- ing the logistics and courier companies. State Assoc i atio n M eetings Not only has Washington DC been shaken up, but state legislatures are seeing changes of their own! Be the first to hear about legislative and regulatory changes in your state by getting involved in your state association in 2017. Several states have had meetings across the country ranging fr om California, Texas, New York to Florida, which you can read about more in the state update section. If you are not aware if your state has an association, contact Madeline Jurch at [email protected]. Not only do these groups provide educational outreach, oppor- tunities to lobby in your home state are possible with the relationships established over the years.
