28 C R IA F A E S A S T O U E T I O N N E W S STATE ASSOCIATIONS UPDATES The CLDA continues to appreciate the involvement of members across the country and especially, the involvement from our corresponding state associations when it comes to keeping us up to date on state legislation! The CLDA was able to get intel on the potential new independent contractor (IC) definitions in Alaska and Vermont and potential workers compensations for couriers in New Jersey. Thank you again to all of those who help us on the grassroots level and connect us with the right people to better inform the larger CLDA membership! CHANGES IN ARKANSAS LAW FOR OPERATORS AND CONTRACTED DRIVERS OF MOTOR VEHICLES On April 10, Arkansas Governor Asa Hutchinson signed Arkansas Senate Bill 635 into law. This Arkansas bill exempts owner-operators and contracted drivers of motor vehicles from the definition of employment for the department of workforce services law. Additionally, CLDA member Chuck Moyer was able to work with legislators to get modi- fied language inserted into the final bill, “as used in this article, ‘employment’ does not include an owner-operator that provides a motor vehicle and the services of a driver to a motor carrier under a written contract. Employees or agents of the owner-operator shall not be considered employees of the motor carrier for purposes of employment security taxation or compensation.” Arkansas Senate Bill 635 will provide clearer provisions for both businesses and employees in the state to follow. On March 30, 2017, the New York State Messenger & Courier Association hosted a successful and informative Town Hall meeting featuring Labor Consultants from New York, New Jersey, and Connecticut. The Town Hall meeting introduced retired directors from the Department of Labor, with representation from New Jersey, Connecticut, and New York. They were Mike McCarthy, Gary Pechie, and our very own Richard Polsinello, respec- tively. The NSYMCA has retained these Labor Consultants to provide services to our Association, and are available to offer our members free advice when they need answers to their labor questions. The Labor Consultants gave an instructive presentation on the state of the union of compliance from a mul- tiple state perspective and led an engaging discussion on best practices on how to stay compliant as we continue to navigate the many changing laws from wage, health, salary, hourly and incentives. The Town Hall meeting also reviewed NYSMCA members’ requests for resources and education to advance our programs that will add value, make strategic connections, stay compliant and ultimately drive new opportunities where we all win. During the NYSMCA Membership Dinner Meeting, Jim Cavanaugh, our lob- byist, discussed how the Uber Bill will be added to the Governor’s budget.
