The criteria for proving religious harassment is the same as for proving harassment based on sex or race. For example, in a case where employees traded offensive and off-color remarks in jest, and a Jewish employee referred to himself as “Bagel” and participated in other banter concerning his religion, the environment was not sufficiently severe or pervasive to alter the conditions of employment. In another case based on religion, the court denied summary judgment because a question of fact existed as to whether the conduct of the company owner towards an employee about her prospects for salvation during working hours, made highly personal inquiries into her private life, and strongly suggested that she talk with God.
