Industry Related CONSTRUCTION LAW: CONSTRUCTION CONTRACTS 101 - COMMON RISK-SHIFTING PROVISIONS IN CONSTRUCTION CONTRACTS AND SUBCONTRACTS The course will address the various types of common contract clauses appearing in construction contracts and subcontracts that shift the risk of non-performance by third parties or other contracting parties. After learning about the various risk-shifting clauses, their meanings, and how to identify them (e.g., choice-of-law provisions, no-damages-for-delay clauses, arbitration clauses, conditional payment clauses, pass-through clauses, offset provisions, and liquidated damages clauses to name a few), attendees will be taught about the various ways such clauses interplay and their real world application.
