Is a Contract

Enforceable Against a

Poor, Unfortunate Soul?

by Talbot Eckweiler

The plot of Disney’s The Little Mermaid hinges on the enforceability of the contract formed between a sea witch and a mermaid. Though the contract is trident-proof, it likely wouldn’t stand up in a United States court of law. Ariel could likely void or rescind the contract by demonstrating her age, the existence of undue influence, the lack of good faith, or showing the contract involved illegal activity. In addition, Ariel can take action against Flotsam and Jetsam for tortious interference with Contract.
